Terms of Service

1. Introduction & Acceptance of Terms

Welcome to Brevitive (the "Platform"), a global crowdsourced service for publishing, discovering, and sharing news and articles. Brevitive is operated by Stanisław Brzeski IT ("we", "us", or "our"), a sole proprietorship registered in Poland.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Stanisław Brzeski IT governing your access to and use of the Platform, including our website at brevitive.com, our iOS application, and our Android application (collectively the "Services").

By creating an account, accessing, or otherwise using the Services, you agree to be bound by these Terms in their entirety and confirm that you have read and understood them. If you do not agree with any part of these Terms, you must not use the Services.

These Terms should be read alongside our Privacy Policy, which forms part of the agreement between you and us.

3. Eligibility & Age Requirements

To use the Services you must be at least 13 years of age. If you are between 13 and 17 years of age (or the age of digital majority applicable in your jurisdiction, whichever is higher), you must have obtained verifiable parental or legal guardian consent before using the Services.

In the European Economic Area, you must be at least 16 years of age to give consent independently, unless the Member State law in your country of residence provides a lower minimum age (but no lower than 13).

By using the Services you represent and warrant that you meet the applicable minimum age requirement and, where required, that you have obtained parental or guardian consent. We reserve the right to suspend or permanently terminate accounts where we reasonably suspect that the age requirements have not been met.

4. Account Registration

You may be required to create an account to access certain features of the Platform. When registering you agree to:

  • Provide accurate, current, and complete information during registration and keep it up-to-date thereafter;
  • Maintain the confidentiality of your login credentials and not share them with any third party;
  • Notify us immediately at brzeski.it@gmail.com of any suspected unauthorised access to your account;
  • Accept full responsibility for all activity that occurs under your account.

You may not create an account on behalf of another person without their express consent, use a false identity, or impersonate any person or entity. We reserve the right to refuse registration or terminate accounts at our sole discretion.

5. Description of the Service

Brevitive is a crowdsourced content platform that allows registered users to create, publish, discover, and share written articles and news items. The Platform is designed to facilitate the free flow of information and journalism from contributors around the world.

We act as a platform intermediary and hosting provider. We do not, as a general rule, editorially review content prior to publication; however, we reserve the right to monitor, moderate, and remove content and to suspend or terminate accounts in accordance with these Terms.

The Services are provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted, error-free, or secure access to the Services at all times.

6. User Conduct & Acceptable Use

By using the Services you agree to act in a lawful, respectful, and good-faith manner at all times. You agree that you will not:

  • Violate any applicable local, national, or international law or regulation;
  • Infringe the intellectual property, privacy, or other rights of any third party;
  • Transmit unsolicited messages, spam, or automated requests;
  • Use the Services to harvest, scrape, or systematically collect data about other users without our express written consent;
  • Attempt to gain unauthorised access to any part of the Services, server, or connected system;
  • Introduce any malicious code, virus, Trojan horse, or other harmful material;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Use the Services for any purpose that is deceptive, manipulative, or harmful to others;
  • Create multiple accounts to circumvent a suspension, ban, or any restriction imposed by us.

7. Prohibited Content

You are solely responsible for all content you submit, publish, or otherwise make available through the Services ("User Content"). You must not publish, upload, share, or otherwise make available any content that:

7.1 Sexual & Explicit Material

  • Pornographic or erotic content — any depiction, description, or suggestion of explicit sexual acts, whether in text, image, or any other format, is strictly prohibited.
  • Nudity — content depicting the naked human body (including partial nudity presented in a sexualised context) is prohibited. The sole exception is content of a genuine medical or anatomical educational nature (e.g., clinical diagrams, peer-reviewed medical literature, or public health information), provided it is clearly labelled and presented in a professional, non-gratuitous manner. Any content attempting to use this exception as a pretext for prohibited material will be removed.

7.2 Harmful, Offensive & Bad-Faith Content

  • Disgusting or grossly offensive content — material that a reasonable person would find grossly offensive, obscene, or revolting with no legitimate informational, educational, or artistic purpose;
  • Provocative or harassment content — content intended to provoke, harass, bully, threaten, or intimidate any individual or group;
  • Bad-faith content — content published with the deliberate intent to deceive, manipulate, or cause harm to individuals, groups, organisations, or public discourse;
  • Hate speech — content that promotes, glorifies, or incites hatred, discrimination, or violence against individuals or groups on the basis of protected characteristics including but not limited to race, ethnicity, nationality, religion, gender, sexual orientation, disability, or age.

7.3 Misinformation & Misleading Content

  • Misinformation — content that presents factually false information as true, particularly where such content could cause public harm (e.g., false medical advice, fabricated news, manipulated or out-of-context evidence);
  • Misleading content — content that, while not wholly false, is presented in a manner designed to deceive, create false impressions, or manipulate the reader's understanding of events, people, or data;
  • Fabricated or manipulated media — synthetic, AI-generated, or otherwise manipulated images, videos, audio recordings, or text presented as genuine without appropriate disclosure.

7.4 Privacy Violations & Doxing

  • Doxing and exposure of private information — it is strictly forbidden to publish, share, or link to private personal information about any individual without their explicit consent. This includes, but is not limited to: home or work addresses, personal telephone numbers, private email addresses, financial information, government-issued identification numbers, passwords, or any combination of information that could be used to identify, locate, harass, or harm a private individual;
  • Non-consensual intimate imagery — sharing any intimate or sexually explicit images or recordings of a person without that person's explicit consent is strictly prohibited and may constitute a criminal offence in many jurisdictions;
  • Unlawful processing of personal data — content that unlawfully processes, exposes, or facilitates the exposure of personal data of third parties in breach of applicable data protection law (including the GDPR).

7.5 Other Prohibited Content

  • Content promoting, facilitating, or instructing on illegal activities;
  • Content infringing the copyright, trademark, or other intellectual property rights of any third party;
  • Content constituting defamation, libel, or malicious falsehood;
  • Spam, advertising, or commercial solicitation not authorised under these Terms;
  • Content that violates any applicable press regulation, online safety law, or court order.

8. Privacy & Personal Data

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

When you publish content that includes personal data about third parties, you are acting as an independent data controller in respect of that data and are solely responsible for ensuring that such processing is lawful, fair, and in compliance with applicable data protection legislation, including the GDPR where applicable.

9. Content Ownership & Licensing

9.1 Your Ownership

You retain all intellectual property rights in the original User Content that you create and publish on the Platform. These Terms do not transfer any ownership of your content to us.

9.2 Licence to Brevitive

By publishing User Content on the Platform, you grant Stanisław Brzeski IT a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, display, reproduce, distribute, and make your content available to other users and the general public through the Services, including via our website and mobile applications. This licence is limited to what is reasonably necessary to operate and promote the Services and will terminate when you delete the content or close your account, except where:

  • The content has been shared or cached by third parties prior to deletion;
  • Retention is required for legal compliance or dispute resolution purposes.

9.3 Your Representations

By submitting User Content, you represent and warrant that:

  • You own or have all necessary rights, licences, and permissions to publish the content and to grant the licence above;
  • The content does not infringe any third-party intellectual property, privacy, or other rights;
  • The content complies with these Terms and all applicable laws.

10. Third-Party Services

The Services integrate with third-party platforms including Apple (Sign in with Apple), Google (Sign in with Google), Amazon Web Services (cloud infrastructure), and PayPal (voluntary donation processing). Your use of those services is governed by their respective terms of service and privacy policies. We are not responsible for the acts or omissions of any third-party service provider.

The Platform may contain links to external websites or resources. We do not endorse and are not responsible for the content, accuracy, or practices of any linked third-party site. Accessing third-party links is done at your own risk.

11. Commercialisation Restrictions

The Services, their content, branding, and underlying technology are the proprietary assets of Stanisław Brzeski IT. The following commercialisation activities are expressly prohibited without the prior, explicit, written consent of Stanisław Brzeski IT:

  • Reselling or sublicensing the Services — you may not sell, resell, licence, sublicence, or otherwise provide access to the Services (or any portion thereof) to any third party for commercial gain;
  • Monetising Platform content — you may not reproduce, redistribute, repackage, or otherwise commercialise content obtained from the Platform (whether individual articles or bulk content) on any third-party platform, website, application, or service without our express written permission;
  • API or data exploitation — you may not use any public or private API, scraping tool, or automated means to extract and commercialise Platform data;
  • White-labelling — you may not incorporate the Services or its content into a competing or derivative commercial product without our express written consent;
  • Advertising on Platform content — you may not wrap, frame, or otherwise embed Platform pages or content in a manner that applies third-party advertising around or within Brevitive content without our authorisation.

Requests for commercial partnerships, licensing, or data agreements should be directed to brzeski.it@gmail.com. Any use not expressly permitted by these Terms is reserved exclusively to Stanisław Brzeski IT.

12. Moderation & Enforcement

12.1 Right to Moderate

We reserve the absolute and unconditional right, exercisable at our sole discretion, to review, moderate, edit, restrict, hide, or permanently delete any User Content at any time and for any reason, including but not limited to:

  • Violation of these Terms or any applicable law;
  • Receipt of a valid complaint or legal notice;
  • Protecting the integrity, safety, or reputation of the Platform or its users;
  • Any other reason we deem appropriate, or for no stated reason at all.

12.2 Right to Suspend or Ban Users

We reserve the absolute and unconditional right to suspend, restrict, or permanently ban any user account at our sole discretion, at any time, and for any reason or no reason, including but not limited to:

  • A breach or suspected breach of these Terms;
  • Abusive, harmful, or disruptive behaviour towards other users or towards us;
  • Receipt of a valid legal request or court order;
  • Protecting the safety and wellbeing of other users or third parties;
  • Any other reason we deem appropriate, or for no stated reason at all.

12.3 No Obligation to Monitor

We are under no obligation to actively monitor all User Content published on the Platform prior to its publication. However, we may choose to do so and reserve all rights described in Sections 12.1 and 12.2 regardless of whether content was actively pre-screened.

12.4 Appeals

If you believe that your content was removed or your account was actioned in error, you may contact us at brzeski.it@gmail.com to request a review. We will consider such requests in good faith but are under no obligation to restore content or reinstate accounts.

12.5 Reporting Violations

If you encounter content on the Platform that you believe violates these Terms or applicable law, please report it to us at brzeski.it@gmail.com. We take all reports seriously and will investigate in a reasonable timeframe.

13. Intellectual Property of Brevitive

The Services and all of their components — including but not limited to the software, source code, design, layout, logos, trademarks, trade names, graphics, text, and the "Brevitive" name and brand — are the exclusive intellectual property of Stanisław Brzeski IT or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in the Platform's proprietary technology or brand assets. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, republish, or commercially exploit any part of the Services without our prior written consent, except as expressly permitted under these Terms.

14. Disclaimers & Limitation of Liability

14.1 Disclaimer of Warranties

The Services are provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of content. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not endorse, verify, or take responsibility for the accuracy, completeness, reliability, or legality of any User Content published on the Platform. Users read and rely on such content at their own risk.

14.2 Limitation of Liability

To the fullest extent permitted by applicable law, Stanisław Brzeski IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

Where applicable law does not permit the full exclusion or limitation of liability, our aggregate liability to you in connection with the Services shall not exceed €100 (one hundred Euros) in any twelve-month period. Some jurisdictions do not allow limitations on implied warranties or exclusions of liability for certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

14.3 User Content Disclaimer

You acknowledge and agree that you, and not Stanisław Brzeski IT, are solely responsible for all User Content you publish. We expressly disclaim all liability arising from User Content, including any claims by third parties relating to content published by users.

15. Indemnification

You agree to defend, indemnify, and hold harmless Stanisław Brzeski IT and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your User Content;
  • Your violation of these Terms;
  • Your violation of any applicable law or the rights of any third party;
  • Your use of the Services.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes we will:

  • Update the "Last Updated" date at the top of this page;
  • Display a prominent notice on the Platform;
  • Where required by law or where we consider it appropriate, notify registered users by email or in-app notification.

Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Services and may request deletion of your account.

17. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.

The courts of Gdańsk, Poland shall have exclusive jurisdiction over any legal proceedings arising out of these Terms, except where mandatory consumer protection law in your jurisdiction requires otherwise. If you are a consumer resident in the European Union, you may also make use of the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Notwithstanding the above, we reserve the right to seek injunctive or other equitable relief in any jurisdiction in order to protect our intellectual property rights or other proprietary interests.
